We appreciate you taking the time to review the following Terms and Conditions of Use (the "Terms") for Playswing11, Fantasy Cricket App. Along with the Terms, any documents expressly incorporated by reference (collectively, the "Terms") govern your ("You" or "Yourself") access to and use of Playswing11, the fantasy cricket contests and services offered thereon, and all information, documents, content, communications, files, text graphics, audio/visual files, software, applications, and/or related services (collectively, the "Application") made available for your ("You," "Your," or "Yourself") use (collectively, additionally, the Playswing11 app is not affiliated with or claims any formal or informal cricket teams or sports figures. IMPORTANT LEGAL NOTICE: PLEASE READ THESE TERMS CAREFULLY AS THEY AFFECT YOUR LEGAL RIGHTS AND OBLIGATIONS. IF YOU DO NOT AGREE TO THE TERMS, DO NOT USE THE APPLICATION.

AGREEING TO THE TERMS AND CONDITIONS

By accessing or using any service from the Application, becoming a registered user ("Registered User") of the Application, or merely browsing the Application, You accept and are bound by these Terms. Playswing11 reserves the right to change the Terms at any time, without prior notice to You. In the event the Terms are materially modified, a notice of the changes and their effective date will be prominently posted on this page. Your continued use of the Application following such changes requires Your affirmative consent to the changes. If You do not agree to the changes, Your sole remedy is to cease using the Application. If You breach any of the Terms, Your authorization to use the application automatically terminates.

ELIGIBILITY AND LEGALITY

ELIGIBILITY

    To be eligible to create an authorized account ("Account") and become a registered user, You must, at the time of registration:

  • Be at least eighteen (18) years of age;
  • Be a citizen or resident of India with an address in India; if you indicate that you live in a prohibited state such as Arunachal Pradesh, Assam, Odisha, Sikkim, Nagaland, Andhra Pradesh, Telangana, or Karnataka you cannot enter any paid contest.
  • Be physically located in a country, state, city or other legal entity (collectively 'Jurisdiction') in which participation in the Application and the services offered thereon is unrestricted by law and these terms and conditions;
  • Not be a person barred from participating in the Application under the laws of India; at all times abide by these Terms. Playswing11 reserves the right to verify Your age, identity, location, and other eligibility requirements at any time by any means. Any failure to cooperate with Playswing11 in this respect may result in the suspension and/or termination of your account. Such persons may, however, use the Application, and will from time to time do so to test the Application, evaluate user experience and contests, socializing and competing with customers to build community and other reasonable and fair uses at the sole discretion of Playswing11.
  • By accessing or using the Application, You represent and warrant that You have the right, authority, and capacity to enter into this agreement, to abide by all of these Terms and that You are not prohibited from accessing and using the Application.
  • Playswing11 does not intend for the Application or the services offered thereon to be used by persons present in jurisdictions in which participation may be prohibited or restricted.
  • You agree that the availability of the Application does not constitute an offer, solicitation, or invitation by us for the use of the Application in any jurisdiction in which such activities are prohibited or restricted.
  • Playswing11 reserves the right to deny access to the Application to anyone at our sole discretion.

LEGALITY

  • As the Legislation of India, Games of skill are legal, as they are excluded from the ambit of Indian gambling legislations including, the Public Gambling Act of 1867.
  • The Indian Supreme Court in the cases of State of Andhra Pradesh v. K Satyanarayana (AIR 1968 SC 825) and KR Lakshmanan v. State of Tamil Nadu (AIR 1996 SC 1153) has held that a game in which success depends predominantly upon the superior knowledge, training, attention, experience, and adroitness of the player shall be classified as a game of skill.
  • You are subject to the laws of the jurisdiction in which You reside and/or from which You access the Application and the services offered thereon.
  • Legal residents of the prohibited jurisdictions are eligible to open and maintain accounts on the Application for use only in games that do not offer cash. If You open an account and/or participate in the services offered on the Application while located in a prohibited jurisdiction, You will violate the law of such Prohibited jurisdiction and these Terms, and subject to having your account suspended or terminated.
  • Playswing11 does not intend that the Application and the services offered thereon to be used by persons present in jurisdictions in which the playing of fantasy cricket contests may be prohibited or restricted.

USER REGISTRATION

To create an account, go to the Application and complete the registration process by verifying your Mobile Number or Email ID or register through a third-party social network. To create an account through the Application, You will be required to submit Your mobile number and other details as requested.

Select a unique username and a password (the "Identifiers"). The username must not be offensive, be selected to deceive or misinform other registered users, and may not offend common decency or infringe upon the rights of third parties. If Playswing11 receives information that a username is illegal or in breach of these Terms, the username can be amended by Playswing11 without prior notice.

VALID INFORMATION

  • You agree to provide true, accurate, current, and complete information about yourself (the "Registration Data") as prompted by the Application's registration form; and - maintain and promptly update the Registration Data to keep it true, accurate, current, and complete.
  • You may modify Your Registration Data by logging into your account and making such changes.
  • Creating an account for the first time via an social networking service (SNS) will prompt You to connect Your Playswing11 and SNS accounts.
  • By creating a Playswing11 account via Your SNS account, you are allowing Playswing11 to access Your SNS account information.
  • If You access the Application from an SNS, you shall comply with the terms of service of the SNS as well as these Terms.

PAYMENT TRANSACTION GUIDELINES

You are solely responsible for the security and confidentiality of your payment accounts linked to your Playswing11 account. The payment made shall be credited to your wallet. Each time you enter a contest, the applicable amount towards participation in the round shall be debited from your wallet.

In debiting amounts from your accounts towards the participation fee of such user in any Contests, Playswing11 shall first debit your usable bonus account thereafter, any remaining amount of participation fee shall be debited from your account and thereafter, any remaining amount of participation fee shall be debited from your winnings account. In case any amount is remaining to be paid by you in relation to such user's participation in any Contest, you will be taken to the designated payment gateway to give effect to such payment.

THIRD-PARTY PAYMENT GATEWAY

  • Credit card, debit card, prepaid cash cards and internet banking payments are processed through third-party payment gateways.
  • Similarly, other payment modes also require authorisation by the intermediary, which processes payments.
  • If there are any issues connected with adding cash, a complaint may be sent to us at [email protected].
  • Once a payment/transaction is authorised, the funds are credited to your user account and are available for you to join cash contests.
  • When making a deposit to a user account, if the transaction fails due to unknown reasons and the amount is deducted from your payment gateway wallet and not credited to your Playswing11 user account, please contact the payment gateway that you used to make the payment for the refund, or you can contact our support team for assistance.

PUBLICITY

  • In an event wherein an individual declared as the winner.
  • Hate speech will not be tolerated.
  • You are solely responsible for Your User Content and may be held liable for User Content You post.
  • You understand that Your use of the Application and any Interactive Areas is at Your own risk and may expose You to User Content that is offensive or objectionable.
  • You agree not to delete or revise any User Content posted by any other party.
  • Any use of the Interactive Areas or other portions of the Application in violation of the foregoing violates these Terms and may result in, among other things, termination or suspension of Your rights to use the Interactive Areas and/or the Application.
  • Please be aware that if any User Content You post within the Application becomes public information, it can be collected and used by others, and may result in Your receipt of unsolicited messages from third parties.
  • Accordingly, Playswing11 discourages You from posting within the Application any personal information that can be used to identify or locate You, such as Your addresses and phone numbers.

INTELLECTUAL PROPERTY RIGHTS

COPYRIGHT INFORMATION AND PERSONAL & NON-COMMERCIAL USE LIMITATION

  • Content within the Application is owned and/or licensed by Playswing11 and is protected by international copyright, trade dress, patent, and trademark laws, international conventions, and other laws protecting intellectual property and related proprietary rights.
  • You may not copy or download any content from the Application unless You are authorized to do so in writing by Playswing11. You agree not to remove, obscure, or alter copyright, patent, trademark, or other proprietary rights notices affixed to content.
  • You may not sell, license, distribute, copy, modify, publicly perform or display, transmit, publish, edit, adapt, create derivative works from, or otherwise make unauthorized use of content.
  • Playswing11 reserves all rights in the content that are not expressly granted to You in these Terms.
  • Making unauthorized copies of content found in the Application may result in the termination ofyour account, prohibition on use of the Application, and further legal action.
  • Content owners may take criminal or civil action against You for unauthorized use of intellectual property.
  • You agree to indemnify and hold harmless Playswing11 from any unauthorized or illegal conduct by You, or through the use of your account, on the Application.

DISPUTES AND DISPUTE RESOLUTION

Any sort of disputes associated with the services provided by Playswing11, including the Contest(s), the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of you (s) (including Participants) or Playswing11 shall be undertaken by the courts of competent jurisdiction. All sorts of disputes, issues, and questions shall be addressed by the court competent jurisdiction in alignment with the Republic of India‘s laws.

LIMITATION OF LIABILITIES

  • You agree to access and use Playswing11 voluntarily and at their sole risk.
  • Further, accepting not to hold Playswing11 responsible or liable on account of any loss or damage sustained including (but not limited to) any accident, injury, death, loss of property by Users or any other person or entity during access to the contests/entry plans (including participation in the Contest(s)) or as a result of the acceptance of any cash pool.
  • The individuals using the services provided by Playswing11 reimburse Playswing11 and/ or any of its directors, employees, partners, associates, and licensors, from and against all the responsibility, liability, cost, loss or expense faced by you due to their access to the Contests/entry plans including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission on their part, or otherwise.
  • Playswing11 shall not be held responsible either jointly or individually, for any sort of errors or omissions, neither on behalf of itself nor on behalf of third parties in terms of the cash.
  • By accepting these terms and conditions, you accepts that he/she shall be held solely responsible for any consequences arising due to an event wherein a user carries out any sort of illegal act due to the non-conformity with these Terms and Conditions and other rules and regulations in relation to services, including the provision of an incorrect address or other personal details.
  • You provide their consent to defend and hold Playswing11 harmless from any third party/entity/organization claims arising due to or associated with your involvement with playswing11.com or your participation in any Contest(s) organized on the Playswing11 platform.

INDEMNIFICATION

You agree to indemnify, save, and hold Playswing11 harmless from any claims, losses, damages, liabilities, including legal fees and expenses, arising out of Your use or misuse of the Application, any violation by You of these Terms, or any breach of the representations, warranties, and covenants made by You herein. Playswing11 reserves the right, at Your expense, to assume the exclusive defense and control of any matter for which You are required to indemnify Playswing11, and You agree to cooperate with Playswing11‘s defense of these claims.

Playswing11 will use reasonable efforts to notify You of any such claim, action, or proceeding upon becoming aware of it. You agree that the provisions in this paragraph will survive any termination of your account or of the Application.

TERMINATION OF APPLICATION AND ACCOUNTS

  • Playswing11 may terminate the entire Application or a portion of the Application and the services offered thereon at any time.
  • Playswing11 also reserves the right to terminate any accounts that have been inactive for 365 days.
  • If Playswing11 terminates your account, You may not again participate in services offered on the Application without Playswing11's express permission.
  • You may cancel your account at any time by following the instructions within the Application or contacting [email protected]
  • During this time, You will not be able to participate in any contest or add any monetary value to your account.
  • If You elect to suspend your account and select the box "Do not unblock me even if I contact your Customer Support" in doing so, You will not be permitted to play under any circumstances until the Suspension Period elapses.
  • You may also elect to permanently delete your account by contacting our customer support.
  • By permanently deleting your account, all Your personal information including identification data, will be permanently deleted and should You choose to re register, You will need to submit applicable reverification identification documents.
  • In the event that your account is terminated or cancelled, You will have no further access to your account or anything associated with it.
  • You can lose Your username and persona as a result of account termination or cancellation.

THIRD PARTY ADVERTISING

You understand that the Application may feature advertisements from Playswing11 or third parties. Playswing11‘s disclosure of information for third party advertising is addressed in our Privacy Policy. Additionally, any charges or obligations You incur in Your dealings with these third parties are Your responsibility. Playswing11 makes no representation or warranty regarding any content, goods and/or services provided by any third party even if linked to from the Application, and will not be liable for any claim relating to any third party content, goods and/or services. The linked sites are not under the control of Playswing11 and may collect data or solicit personal information from You. Playswing11 is not responsible for their content, business practices or privacy policies, or for the collection, use or disclosure of any information those sites may collect. Further, the inclusion of any link does not imply endorsement by Playswing11 of these linked sites.

FAIR PLAY GUIDELINES

By entering a Contest, you agree to be bound by these Terms and the decisions of Playswing11. Subject to the terms and conditions stipulated herein below, the Company, at its sole discretion, may disqualify any user from a Contest, refuse to award benefits or cash and require the return of any cash, if you engages in unfair conduct, which the Company deems to be improper, unfair or otherwise adverse to the operation of the Contest or is in any way detrimental to other Users which includes, but is not limited to:

  • Falsifying one‘s own personal information (including, but not limited to, name, email address, bank account details and/or any other information or documentation as may be requested by Playswing11 to enter a contest and/or claim a winning;
  • Engaging in any type of financial fraud or misrepresentation including unauthorized use of credit/debit instruments, payment wallet accounts etc, to enter a Contest. It is expressly clarified that the onus to prove otherwise shall solely lie on you;
  • Colluding with any other user(s) or engaging in any type of syndicate play;
  • Any violation of Contest rules or the Terms of Use;
  • Accumulating points or cash through unauthorized methods such as automated bots, or other automated means;

PRIVACY AND DATA COLLECTION

Playswing11’s Privacy Policy is an integral part of these Terms and is incorporated into this document by reference. If You do not agree to each and every part of our Privacy Policy, then You should not use the Application or submit any personally identifiable information through the Application. MAINTENANCE AND UPDATES TO THE APPLICATION

Playswing11 conducts maintenance work on its system from time to time mainly to ensure security and integrity. A portion, or sometimes all, of the features of the Application will not be available during maintenance periods. If possible, You will be notified of maintenance periods in advance, however, You hereby agree that Playswing11 may update the Application with or without notifying you.

All problems encountered during the use of the Application, including those with regard to your account, etc, can be reported to Playswing11 when the problem is encountered at [email protected].

MISCELLANEOUS

In alignment with certain legislation, Playswing11, a Playswing11 game platform, is bound to notify you of various events. In this regard, you, by accepting these Terms and Conditions, provide their consent that such notification issued and posted by Playswing11 on either playswing11.com or conveyed through the email provided by the customer while registration will be considered adequate and authorised, and will be effective upon the customers. Further, Playswing11 shall not be held responsible for any loss of information or failing to notify you if you fail to provide adequate and accurate information at the time of registration.

Playswing11 shall not be held responsible for delay or failure in notifying you, organizing/providing services, Entry Plans and Contest(s) because of outside reasons considered to be out of the reach of Playswing11, including (but not limited to) any failure to perform due to unforeseen circumstances or cause beyond Playswing11‘s control such as acts of god, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labour or materials or any cancellation of any match to which a Contest relates. If such an event ever happens then, Playswing11 holds all the rights to cancel any related Contest(s) and process an appropriate refund for all Participants.
